Smoke Free Air Act

Q: We have a question regarding the Smoke Free Law passed a few years back. We currently have a patio immediately out the doors of our restaurant. Is there any kind of leniency in the law regarding this? We have allowed smoking on it since opening in 2005, but we have concerned citizens who have intimated to us that we are not in compliance with the law regarding this. Was hoping you might could give me some advice as to the legality of this.

A: The state Smoke Free Air Act excludes all patios. This means there are no restrictions pertaining to smoking on outdoor facilities.You may want to check your local (county or city) ordinances to see if they have a rule that does. If so, it would supersede the state law.
